These Terms & Conditions ("Terms") govern your use of Seawidth and all associated applications operated by Plooran (OPC) Private Limited ("Plooran", "we", "us"). By creating an account or using our services, you agree to these Terms.
1. Services
Seawidth is a suite of personal management applications including Guest Manager (event & invitation management), Memories (photo & media album management), and other applications that may be added. Access is provided on a subscription basis.
2. Subscriptions and Payments
- Subscriptions are offered in monthly validity periods (each month counted as 30 days).
- Payment is processed via Razorpay in INR or USD. All transactions are final unless otherwise required by law.
- Subscription validity begins on the date of activation. You may extend your subscription before or within 30 days of expiry.
- After 30 days of expiry, all data associated with the subscription will be permanently deleted and cannot be recovered.
- Coupon codes are single-use, non-transferable, and valid only for the product specified.
3. Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate information and keep your account details Recommended for date.
- You must not share your account access with others or use the service on behalf of third parties without authorization.
4. Acceptable Use
You agree not to use Seawidth to:
- Upload, store, or transmit content that is unlawful, defamatory, obscene, or infringes on any third-party intellectual property rights
- Transmit malware, viruses, or any code designed to disrupt or damage systems
- Attempt unauthorized access to Seawidth systems, APIs, or other users' data
- Use the service for any commercial resale or redistribution without written permission from Plooran
- Violate any applicable Indian or international laws or regulations
5. Content Ownership
You retain ownership of all content you upload to Seawidth. By uploading content, you grant Plooran a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the service to you.
6. Service Availability
We aim to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience outages. We will endeavor to provide advance notice of planned downtime where possible.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Plooran shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising from your use of or inability to use Seawidth services. Our total liability to you shall not exceed the amount paid by you for the subscription in the preceding three months.
8. Termination
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your access will cease and data will be deleted in accordance with our retention policy.
9. Governing Law
These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of courts in India.
10. Modifications
We may update these Terms from time to time. We will notify you of material changes. Continued use of the service after changes take effect constitutes your acceptance of the revised Terms.
